Selling a House in Windermere

We buy houses in Windermere and surrounding Central Florida communities. This page explains the question that decides almost everything else here: whether the house is inside the Town of Windermere or only has a Windermere mailing address.

Quick answer

Most houses with a Windermere address are not in the Town of Windermere. The town describes itself as about 2.2 square miles with roughly 1,600 parcels, while the Windermere zip code holds about 30,000. If your house is inside the town, the town’s own permitting, tree and code rules apply. If it is outside, Orange County governs it, usually alongside a homeowners association. Find out which before you look up permits or liens, because you would otherwise be asking the wrong office.

Town of Windermere, or a Windermere address?

The mailing address comes from the post office, which sorts the mail, not from the town boundary. The town’s own frequently asked questions page says that addresses outside the limits do not pay taxes to Windermere and are not served by its police or public works departments.

The town suggests a simple check. Search the address on the Orange County Property Appraiser site and look at the Municipality heading on the parcel record:

  • If it shows Windermere, the property is inside the town. Use the town resources below.
  • If it shows Unincorporated, Orange County handles permits and code enforcement. Use the county resources below.

Town boundaries also change over time through annexation, so check the current record instead of relying on what a neighbor or an old listing says.

Permits

The town does not run building permits from the town office. Its Development Services page sends building permit applications and inspection requests to a contracted building services firm, and planning and zoning questions to the town’s contracted planner. If you are checking whether past work on the house was permitted and closed out, that is where to ask.

Trees

The town takes tree removal permit applications, so removing trees to prepare a house for sale is not always a weekend job. The same page quotes the state law, section 163.045, that removes the permit requirement on residential property when a certified arborist or licensed landscape architect documents that a tree is a danger.

Docks and shoreline

Much of the town sits on the Butler Chain of Lakes. The town says it has additional rules of its own for wetland and shoreline projects, and Orange County’s boat dock permitting applies as well: the county’s environmental permitting guide lists Windermere among the places where a new dock needs a county environmental permit plus a building permit. A dock or boathouse built or altered without both can come up in a buyer’s inspection or survey.

If the house is outside the town

For an unincorporated Windermere address, Orange County is the local government:

Most of the newer communities around Windermere are also governed by a homeowners association, and many are gated. The association has its own approval process for exterior changes and its own charges. Before closing, the title agent requests an estoppel certificate showing what is owed to the association, a process set out in section 720.30851 of the Florida Statutes. Unpaid assessments and fines are normally settled from the sale proceeds.

Selling costs and considerations

Windermere properties range from older lake cottages and ranch homes inside the town to large recent houses in the surrounding communities. On a lakefront lot, a buyer’s lender and insurer will look at the flood zone, the seawall and the dock as well as the house. On an older home, expect questions about the roof, electrical, plumbing and air conditioning. The usual selling costs apply: agent commission on a listed sale, which is negotiable, title and closing costs, any repairs a buyer asks for, and taxes, insurance, association dues and utilities until closing. On a higher-value house those carrying costs add up quickly each month.

As-is versus a traditional sale

A well-kept house in this area generally does best on the open market, and we will tell you so. An as-is sale is worth comparing when the house needs major work, when unpermitted additions or dock work would have to be legalized before a financed buyer could close, or when an inherited house is sitting vacant while the costs run. Put your own figures into the cash sale vs traditional sale calculator to see what each route would leave you.
